Red9 Privacy Notice

Solution Square, Inc. d/b/a Red9 (“Red9,” “we,” “us,” or “our”) recognizes the importance of privacy, security, and transparency. This Privacy Notice explains how we collect, use, and disclose Personal Data and the choices individuals have regarding their Personal Data.
References to “Personal Data” in this Privacy Notice mean information that identifies or relates to an identifiable individual or is linked or reasonably linkable to an identifiable individual.
This Privacy Notice supersedes and replaces any prior privacy policy published by Red9.
1. SCOPE
This Privacy Notice applies to Personal Data we collect through:
- our websites at red9.com and related Red9-operated subdomains and pages (the “Sites”);
- our software products that we make available for download or use, including the Red9 SQL Server Health Check tool (collectively, the “Software”); and
- our marketing, sales, and business communications.
This Privacy Notice does not apply to:
- Information processed under a separate agreement with a Red9 client. Where Red9 provides services under a Master Services Agreement, statement of work, or other written agreement with a client, the terms of that agreement (and any data processing addendum to it) govern Red9’s processing of information on behalf of that client. In those engagements, Red9 acts as a service provider or processor on the client’s behalf, and the client’s own privacy policies apply to the underlying data.
- Personal Data of Red9 personnel. Personal Data we collect about Red9 employees, applicants, and contractors is covered by separate notices provided to those individuals.
2. PERSONAL DATA WE COLLECT
The Personal Data we collect, and how we use it, varies depending on the nature of our interactions with you. We collect the following categories:
- Identifiers. Name, business email address, phone number, company name, job title, IP address, and other similar identifiers.
- Customer and prospect records. Contact information, communications with us, requests for information or proposals, and similar information that you provide when you inquire about or engage Red9.
- Usage details. Information about your interactions with the Sites and Software, including pages visited, features used, browser type, operating system, device information, referring URLs, dates and times of access, and similar usage data.
- Software operational data. When you install or run the Software, we may receive technical and performance data from the systems on which the Software is installed or run. The specific data collected by each Software product is described in the End User License Agreement and applicable Product Schedule for that product, available at https://red9.com/legal/eula/.
- Communications. Records of correspondence with us, including emails, support tickets, and similar communications.
- Cookies and similar technologies. Information collected through cookies, pixels, tags, and similar technologies, as further described in Section 7.
We do not knowingly collect Personal Data from children under 16 years of age. The Sites and Software are intended for business use and are not directed to children.
3. HOW WE USE PERSONAL DATA
We use Personal Data for the following purposes:
- to operate, maintain, and improve the Sites and Software;
- to respond to inquiries, provide information requested by you, and deliver any reports, deliverables, or services that the Software is designed to produce;
- to communicate with you about Red9’s products, services, events, and offerings, including direct marketing where permitted by law;
- to analyze and understand how visitors use the Sites and Software, and to develop new features and offerings;
- to develop aggregated and de-identified data that does not identify you or any individual;
- to protect the Sites, the Software, our business, and the rights and safety of Red9 and others, including detecting, preventing, and responding to fraud, misuse, security incidents, and unlawful activity;
- to comply with legal obligations and respond to lawful requests by public authorities; and
- for general business operations, including accounting, recordkeeping, and corporate transactions.
4. HOW WE SHARE PERSONAL DATA
We share Personal Data only as necessary to operate our business and provide the Sites and Software. We do not sell Personal Data, and we do not share Personal Data with third parties for their own marketing or commercial purposes. Specifically, we share Personal Data as follows:
- Service providers. We share Personal Data with third-party service providers that perform functions on our behalf, including cloud hosting and infrastructure (including Microsoft Azure), customer relationship management, customer support, project management, communications, marketing, and analytics. These providers process Personal Data only as necessary to provide their services to us and are bound by confidentiality and data protection obligations.
- Advertising and analytics partners. We share certain Usage Details with third parties that provide advertising, measurement, and analytics services to us, as further described in Section 7.
- Professional advisors. We share Personal Data with our accountants, lawyers, insurers, and similar professional advisors as needed for the operation of our business.
- Legal process and protection. We may disclose Personal Data in response to subpoenas, court orders, or other legal process; to comply with applicable law; to enforce our agreements and policies; or to protect the rights, property, or safety of Red9, our personnel, our customers, or others.
- Business transfers. In the event of a merger, acquisition, sale, reorganization, financing, bankruptcy, or other transaction involving all or part of our business or assets, Personal Data may be transferred as part of that transaction.
- Aggregated or de-identified data. We may share aggregated or de-identified data that does not identify any individual for any lawful business purpose.
To the extent that any of our use of cookies and similar technologies described in Section 7 constitutes a “sale” or “sharing” under California law, you may opt out as described in Section 9.
5. INTERNATIONAL TRANSFERS
Red9 is based in the United States and processes Personal Data in the United States. If you access the Sites or Software from outside the United States, your Personal Data will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.
Where required by applicable law, we implement appropriate safeguards for international transfers, including the European Commission’s Standard Contractual Clauses or equivalent mechanisms. You may contact us at the address in Section 11 for more information about the safeguards in place.
6. RETENTION
We retain Personal Data for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by applicable law. Our general retention practices are:
- Software Operational Data (identifiable): approximately 24 months from the date of collection. Aggregated or de-identified data derived from Software Operational Data may be retained indefinitely.
- Personal Data submitted through Site forms or Software registration: approximately 3 years from your last interaction with us, unless you remain in an active business relationship with Red9, in which case we retain it for the duration of that relationship plus a reasonable period thereafter.
- Site usage data (cookies, analytics, server logs): approximately 13 months.
We may retain Personal Data for longer where retention is required by law (for example, tax and accounting records), is necessary to resolve disputes, enforce our agreements, defend legal claims, or where retention is otherwise advisable in light of our legal position.
7. COOKIES AND SIMILAR TECHNOLOGIES
The Sites use cookies, pixels, tags, and similar technologies (collectively, “Cookies”) for purposes including:
- operating the Sites and remembering your preferences;
- analyzing how visitors find and use the Sites, so that we can improve them;
- measuring the performance of our marketing campaigns; and
- delivering advertising about Red9 on third-party websites and platforms.
We use both first-party Cookies and Cookies provided by third-party service providers, including providers of analytics and advertising services. These third parties may use Cookies to collect information about your activities on the Sites and on other websites over time.
Where required by applicable law, we present a cookie banner that allows you to consent to or decline non-essential Cookies. You can also manage Cookies through your browser settings. Disabling Cookies may affect the functionality of the Sites.
8. SECURITY
We maintain administrative, technical, and organizational measures designed to protect Personal Data against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is fully secure, and we cannot guarantee the absolute security of Personal Data.
Where we are required to do so under applicable law, we will notify affected individuals or supervisory authorities of personal data breaches. For Personal Data subject to the General Data Protection Regulation or UK GDPR, we will notify the relevant supervisory authority within 72 hours of becoming aware of a qualifying breach, where required. For Personal Data subject to other laws, we will provide notification without undue delay and in accordance with applicable law.
9. YOUR RIGHTS AND CHOICES
9.1 Marketing communications.
You may opt out of receiving marketing communications from us at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at [email protected]. We may continue to send you transactional or service-related communications even if you opt out of marketing.
9.2 Privacy rights.
Depending on where you reside, you may have rights with respect to your Personal Data, which may include the right to:
- request access to the Personal Data we hold about you;
- request correction of inaccurate or incomplete Personal Data;
- request deletion of your Personal Data;
- object to or restrict our processing of your Personal Data;
- request a copy of your Personal Data in a portable format; and
- withdraw consent where our processing is based on your consent (without affecting the lawfulness of processing prior to withdrawal).
To exercise any of these rights, please contact us at [email protected]. We will respond to your request in accordance with applicable law. We may need to verify your identity before processing your request, and we may decline or limit a request where permitted by law.
9.3 Additional information for California residents.
California residents may have additional rights under the California Consumer Privacy Act, including the rights described in Section 9.2 and the right to opt out of any “sale” or “sharing” of Personal Data for cross-context behavioral advertising. 9.4 Additional information for EEA and UK residents.
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights described in Section 9.2 under the General Data Protection Regulation, the UK GDPR, or equivalent local law. We rely on the following legal bases for processing your Personal Data, depending on the purpose: performance of a contract with you, our legitimate interests (such as operating and improving our business), compliance with legal obligations, and your consent (where required).
You also have the right to lodge a complaint with the supervisory authority in your jurisdiction.
10. THIRD-PARTY SITES
The Sites may contain links to websites, products, or services operated by third parties. This Privacy Notice does not apply to those third parties. We are not responsible for the privacy practices of third parties, and we encourage you to review the privacy notices of any third-party site you visit.
